Synopsis: The Allahabad High Court has issued a contempt notice to the Noida Authority for failing to register approximately 300 flats in the Lotus 300 project in Sector 107. This action comes after the High Court’s earlier order in February 2024 mandated the registration within a month and a half, which was not fulfilled by the Noida Authority.
Homebuyers in Noida’s Lotus 300 project have received a glimmer of hope as the Allahabad High Court issued a contempt notice to the Noida Authority. The notice pertains to the Authority’s failure to register nearly 300 flats in the project, despite a court order issued in February 2024.
The earlier order, passed in late February by a single bench of Justice Rohit Ranjan Agarwal, directed the Noida Authority to register the flats within a month and a half. This deadline was not met, prompting the Lotus homebuyers’ association to file a contempt petition.
According to the petition, the Noida Authority cited outstanding dues from the developer, amounting to Rs 166 crore, as the reason for the delay in flat registrations. However, the High Court rejected this reasoning in its previous order, stating that the homebuyers should not be penalized for any disputes between the developer and the Authority.
The contempt notice issued on May 27th, 2024, requires Lokesh M, the CEO of the Noida Authority, to appear before the court and explain the reasons for non-compliance with the earlier order. This development has been welcomed by the Lotus 300 flat owners who have been facing delays in registration for years.
“The Authority had done gross contempt by not registering the flats despite several reminders,” said Bhuwan Chaturvedi, president of the AOA (Apartment Owners Association) for Lotus 300. “We are hopeful that the court will take strict action against the Noida Authority for this blatant disregard of its orders.”
The outcome of this contempt case is yet to be determined. However, it signifies a potential breakthrough for the Lotus 300 homebuyers who have been battling for timely registration of their properties.
