A real estate dispute between Orris Infrastructure and Godrej Properties has escalated, reaching the Delhi High Court. Orris, the complainant, has accused Godrej Properties of failing to fulfill payment obligations for land purchased in Gurugram. The court will need to determine jurisdiction before addressing the core dispute.
A legal battle between two prominent real estate developers, Orris Infrastructure and Godrej Properties, has taken a new turn with the case reaching the Delhi High Court. The dispute centers on a land deal in Gurugram, with Orris accusing Godrej Properties of defaulting on payments for acquiring 10 acres of land for a project called ‘Godrej Air.’
According to Orris Infrastructure’s complaint filed earlier, Godrej Properties was obligated to pay Rs. 202 crore for the land by September 2022. However, Orris alleges that Godrej has only paid Rs. 37 crore so far, constituting a significant breach of contract.
This non-payment prompted Orris to file an FIR (First Information Report) with the Delhi Police’s Economic Offences Wing (EOW) in April 2024. The FIR accuses Godrej Properties and its top management of criminal breach of trust, cheating, and criminal conspiracy under relevant sections of the Indian Penal Code (IPC).
The case has now reached the Delhi High Court, with a crucial preliminary hurdle to address first. Legal jurisdiction needs to be established before the court can delve into the core dispute regarding the alleged payment default. This will determine which court has the legal authority to hear the case.
Godrej Properties has yet to issue a public statement on the matter.
