UP-RERA clamps down on temporary occupancy certificates to bolster transparency and buyer protection in Uttar Pradesh’s real estate market.
In a move aimed at protecting homebuyers and promoting transparency in Uttar Pradesh’s real estate market, the Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has tightened its grip on the issuance of occupancy certificates. UP-RERA has directed all relevant authorities within the state to stop issuing temporary occupancy certificates (OCs). This directive comes after concerns were raised about the legitimacy and consistency of these certificates.
Previously, some authorities were issuing part-completion certificates (CCs) or temporary OCs, which lack legal recognition under current real estate laws in India. These certificates also created confusion as the names of completed towers or blocks listed on them often differed from the project details submitted by developers to UP-RERA during registration. This discrepancy caused anxieties for both homebuyers and the regulatory body.
By eliminating temporary occupancy certificates, UP-RERA aims to streamline the process and ensure that homebuyers receive proper documentation before moving into their new properties. This directive promotes adherence to established regulations and protects homebuyers from potential issues that might arise from inconsistencies in the occupancy certificates.
